A non-molestation order is a form of legal protection designed to safeguard individuals and children from abuse, harassment, or threats from a partner, former partner, or family member. It is an injunction issued by the family court which can restrict a person from contacting you, approaching you, or engaging in certain behaviour.

Applications for a non-molestation order are made to the court using Form FL401, supported by a detailed witness statement explaining the behaviour and why protection is required. In urgent cases, the court can grant an order without notice to the other party, providing immediate protection where there is a risk of harm.

To obtain an order, the court must be satisfied that there is evidence of the behaviour complained of and that protection is necessary for you or any relevant child. If granted, the order will set out clear restrictions on the respondent’s conduct. Breaching a non-molestation order is a criminal offence and may result in arrest.
